UNIUYO: SHIFTS EXAMINATION DATE



HOPE FOR NIGERIAN STUDENTS AS THE STUDENTS' UNION SENATE TAKES THE GRIEVANCES OF ALL UNDERGRADUATES TO THE SCHOOL'S MANAGEMENT


The Students' Union Senate led by distinguished Sen. Mbetobong Udoh on Wednesday, 11th January, 2017, had a courtesy meeting with the University's management team. The meeting had in attendance the Vice Chancellor, Dvc Administration, Dvc Academics, Registrar, Bursar, Chief Librarian, Dean of Students, Deputy Registrar and distinguished Students' Union Senators representing the 13 faculties of University of Uyo.

The Senate President in his address appreciated the management for putting smiles on the faces of Students by extending the payment of fees indefinitely and specifically thanked the Vice Chancellor for always being there for the Students.

He proceeded directly to the business of the day by expatiating the present pressing grievances of Nigerian Students and requested for a new hostel to replace the lost hostel at Udi street, adequate security across all campuses, 24 hours library services, routine washing of hostel water storage tanks, personalisation of results checking website, giving of supplementary continuous assessment test to 100level students coming in through the supplementary list, extension of semester's examination date and reduction of development levy from school fees of students.

After a brief deliberation, the management considered shifting the commencement of examination date from 30th January to 13th February, 2017, an order was made for supplementary continuous assessment test for 100level students coming in through supplementary list, a notice of cleaning of water tanks was sent to the director of works as well as personalisation of result checking website for purpose of students result confidentiality.

Concerning 24 hours library services, the chief librarian observed that the request is very possible but for the Institution to start operating a 24 hour Library service, factors like adequate security and constant power supply will have to be in place and as such promised that the University is still growing and will soon get to that point.

The Vice Chancellor noted that the NDDC hostel will soon be completed to remedy the hostel Challenges, promised to do his best in restoring adequate security on campus but the development levy will not be reduced as the University is looking at adding more facilities to the institution, transforming it into a citadel that can compete with other tertiary institutions outside.

He urged the University of Uyo students to be security conscious, peaceful and be committed to learning so as to help build a better society.

The Deputy Senate President distinguished Sen. Nsisong Ikon while giving the vote of thanks on behalf of the Students promised solidarity and the Students Undivided support towards making the administration a success as well as University of Uyo an outstanding citadel of learning.

ADVOCACY CHAMBER, NOT FOR SALE!

BUSTED: ADVOCACY CHAMBERS, FACULTY OF LAW, UNIVERSITY OF UYO, NOT FOR SALE






It has come to the notice of some concerned persons in the Faculty of Law, University of Uyo that effort is in top gear to sell Advocacy Chambers Int'l to a politician in the state. The development as reported is not unconnected to the upcoming LAWSAN Presidential Election. The auctioning of the Chamber is said to be used as a consideration for the success of two aspirants who incidentally are also members of the Chambers and at the time of fielding this report, the two aspirants are hell bent on dispensing with the Chambers in order to have the means to campaign and be elected the LAWSAN President. One will ask, "is that not a sure evidence of ineptitude on the part of the aspirants? How are we sure LAWSAN too will not be sold?"

What baffles sensible LAWSANites is the apparent lack of their knowledge of the procedural law of LAWSAN. Heck, need I remind the Chambers' auctioneers that in LAWSAN, things must adhere to procedural laws? Do I need to inform them for the umpteenth time that it is so very impossible to sale, lease, mortgage or change the character of any Chamber without recourse to the LAWSAN constitution?

This is not the first time in the history of LAWSAN that some external Oligarchs attempted to thwart our constitution in a bid to further their selfish reasons. In 2013, the LAWSAN House of Representative had rejected the creation of a new Chamber which was to be tagged "Godswill Akpabio Chambers" because it did not follow the laid down procedure of law, and as such, the efforts of the proponent of that idea became null and void and of no effect whatsoever. A perpetual injunction had also been obtained against the act and it is still running and it will run in perpetuity except the law vacates it.

Section 54 of the LAWSAN Constitution expressly laid down the procedure through which the alteration of any Chambers can be done. It provides thus:

(1) There shall be for LAWSAN the following Chambers;
(a) Ime Umanah Chambers
(b) Magna Juris Confraternity
(c) Advocacy International Chambers
(d) Udo Udoma Chambers

(2) The number of Chambers RECOGNIZED by this Constitution may be by law enacted by the LAWSAN House of Assembly be increased or decreased.

The above statutory provisions goes to consolidate the fact that, No Chambers existing in the Faculty of Law can change its character without first. setting the necessary machinery of the LAWSAN House of Assembly in motion, and which incidentally will also lead to the amendment of the LAWSAN Constitution.

I expected that the proponent of Advocacy Chambers auctioning should have had recourse to the LAWSAN constitution before they embark on this effortless, futile and rub-a-dub styled wanton suicidal processes of undermining the supremacy of the LAWSAN constitution. I am not sure that Emaediong Akpan, the then indefatigable Advocate General of Advocacy International who administered the Chambers in her days with creative ideas is aware of this development. I am skeptical of how the past Advocate General would feel should the information of the Chambers auctioning is put to them. If they are aware and still feign ignorance in order to play the devil's advocate, too bad.
It is noteworthy that Advocacy Chambers had survived over the years without any encumbrances and has produced prominent LAWSAN Presidents and Lecturers, among whom were, Dr. Etefia Ekanem and Comrade Edidiong Peter. The question is "Why the sudden auctioning?"

It is instructive for all LAWSANites to note that, it is not wrong to change a Chambers name, but such a chamber must undergo the legal process of doing so. On this note, I advise the current Advocate General, who is also the the President of LAWSAN Bar Association,that if at all, the alleged intention to change the Chambers name is true, he should behave as a Senior Advocate of LAWSAN, approach the House of Assembly, set the legislative machinery in motion for the amendment of the LAWSAN constitution as enshrined in section 1-7, if it sails through, then, the House is bound to amend the appropriate Section in order to insert the new name for the purpose of recognition as enshrined by Section 54.

However, anything short of what the Constitution says shall be resisted within the bounds of the law.

PARTICULARS OF IMPEACHMENT

For the benefit of hindsight and for the purpose of clarity, we wish to state unequivocally, and bring to the notice of the general public, the particulars of impeachment against the LAWSAN President.

IMPEACHMENT NOTICE

Pursuant to powers granted the LAWSAN House of Assembly vide section 11 (1) (f) of the LAWSAN Constitution, we the undersigned members of the LAWSAN House of Assembly hereby tender this notice of impeachment to the President of LAWSAN pursuant to section (58)(2) of the LAWSAN Constitution.

PARTICULARS OF IMPEACHMENT

1. That the President has failed in his Constitutional duties to uphold and  protect the sanctity of the LAWSAN Constitution which he swore to uphold.

2. That the President has failed in his Constitutional duties to convene a Congress, since his inception for the purpose of presenting the Financial Report of LAWSAN as provided for in section 53(2) of the LAWSAN Constitution.

3. That the President, having failed to convene a Congress since last semester, as provided for in the LAWSAN Constitution also failed to constitute a "Revenue Allocation and Fiscal Committee" for the purpose of auditing the account of the association as provided for in section 57(8) (a) and (c) of the LAWSAN Constitution.

4. That the conduct of the President has not only prejudiced the provisions of section 57(8)(e) but has also thwarted the workability and functionality of section 57(8)(J) of this Constitution, contrary to section 1(1)(4) of the LAWSAN Constitution.

Latest reports reaching us at Revolutionary Youths has confirmed that the President, Law Students Association of Nigeria (LAWSAN), Faculty of Law, University of Uyo, Uyo. (Iyene John) has just been served an impeachment notice by the LAWSAN House of Assembly, today 14/6/2016.

The House resolved to impeach the underperforming President during it's sixth (6th) sitting of the academic session. Monday, 13/6/2016.

The motion for his impeachment was initiated by the House Leader Hon. Uwemedimo Dominic (Paapa Akpan) which was met with an overwhelming support from the 10 members who were present at the sitting.

All attempts to get in touch with the President proved abortive.

Would Iyene John be the first LAWSAN President to be impeached? Time will tell.

THE NIGER DELTA HAVOC AND THE SOUTH SOUTH GOVERNORS : A CONSPIRACY OF SILENCE

Recent happenings in the Niger Delta region of Nigeria, particularly, the South South has raised a cause of concern as to the viability and workability of the political Institutions of those states. The greatest threat to the survivability of the region presently is the emergence of the Niger Delta Avengers, a group many see as coming out straight from Hell.

The Niger Delta Avengers started as a kindergarten local militia which many saw and treated with kid gloves,they made several demands which was anchored on some sense(less)(ible) demand from the Federal Government, and from their body language which was unusually calm, sent a very weak signal to the Federal Government even including the citizens that they are just some hunger-driven fellows who will be effortlessly crushed by the Federal might. However, the reverse has turned out to be the case as the group has surprisingly and increasingly lived up to their threat. The consistent destruction of the oil facilities in the region has taken the Federal Government by surprise. The Avenger's vengeful way of repelling the joint force sent to the zone to quell the crisis is a sure fact that the group will not seize their pipeline bombardment soon.

It is most worrisome and perhaps, curious, that in spite of threat to security of lives and property in the region, the Governors of South South who are also the Chief Security Officer's of their respective States are extraordinarily silent, as if there is a general peace and tranquility in the area. I have always been against the vandalization of oil facilities and unrest in the Niger Delta region by whatever guise, whether as a message against environmental pollution and degradation or against marginalization of it's citizens, but it is always a curious thing to discover that, the Chief Executive Officers of this region are unusually calm and silent over the sad situation. One wonders the problem of the South South leaders when it occurs to him that this is not the first time the South South is experiencing this type of situation.

Some time in mid-1980's, the minorities were left in the equation of governance and control in Nigeria, from whose land much of the resources are exploited. In a country were there is no environmental protection, the oil companies continue to operate insensitively, often times,leaving the people with a complete devastated environment. It is even more pathetic seeing the people in a pristine conditions such as existed hundred years ago yet billions of dollars worth of oil were being carted away from beneath their mud houses that have neither pipe-borne water nor electricity. It is not uncommon to see children in an oil rich community with kwashiorkor as a consequence of severe malnutrition. Tam David-West from a minority state was a Petroleum Minister under Babaginda. According to Tom Mbeke Ekanem in his book "Beyond the Execution", he uncovered a massive fraud with tentacles all the way to the top, and when he questioned this, not only was he relieves of his post, he was sent to jail on frivolous charges. For Tam, as a principled individual, he did not have to toe the line and be a 'yes-man' like a slave.

Again, after years of unanswered demands and protest against exploitation of their land by the oil companies and the Nigerian Government, in 1990, the Ogoni people decided to formally organize themselves into a powerful bargaining group. They issued series of demands in the form of Bill of Rights to the Nigerian government, adopted and signed by the representatives of the six clan, Ken Saro Wiwa though the initiator of the Bill of Rights, had no portfolio, but was just one of the six signatories representing Ken Khana. To carry out the aims and objectives of the Ogoni Bill of Rights an organization known as the "Movement for the Survival of Ogoni People" was formed. It's first President was Garrick Barilee Leton. Ogoni had in 1993 gathered more men and women for a celebration of what is called "The Year of Indigenous People" were Saro-Wiwa, the ever energetic  Speaker said "in recovering the money that has been stolen from us, I do not want any blood spilt; not of the Ogoni man and not of any stranger among us." However, Ken was later framed by the Federal Government as causing the attack of some elders, like Alhaji Kobain, Baday and so on. He was charged with murder of four men, alongside other Ogoni activists. One of the things that inspired me about is his doggedness and unwavering belief in the trueness and rightness of his cause. In one of his trials, he adapted one of the famous English writer William Blake: "I will not cease from mental fight, nor shall my pen sleep in my hand till we have built a new Ogoni in Niger Delta wealthy land." The defence team for Saro Wiwa and other accused, led by the late Chief Gani Fawehimi made several unsuccessful submissions that their client have no case to answer. He was nevertheless sentenced to death by hanging. But before he departed, he said: "I call upon Ogoni People, the people of Niger Delta and the oppressed ethnic minorities to stand  up and fight fearlessly and peacefully for their rights."

It may perhaps be said that his Excellency, Architect (Obong) Victor Attah heeded this advice, when in 2002, he dragged the Obasanjo led Federal Government to court to review the hitherto derivation principle which was also a continuation of the marginalization of the minority. Attah's vision for Nigeria has placed him as one of the foremost National patriots. Obong Attah's conception of the Resource Control issue, as he has rightly explained to other Nigerians at many fora has been to seek more creativity, Indigenous participation and control of the commanding height of the national economy, better economic opportunities and local resourcefulness. As Chairman of Governors forum, Obong Attah used the forum as a check to the Federal Government, and was successful in forging the unity of the South South through the Governors of their respective states. Little wonder they were able to contend with the all powerful Obasanjo-led Federal Government. Attah won so many international accolades for his role in Governance and Resource Control including international Award for Honour in Leadership role in Governance and Resource Control from the Nigerian family Association is Sweden.

In the same vein, Rt. Hon. Chibuike Amaechi, in his days as the Governor of Rivers state, took over from where Obong Attah stopped. He challenged the Jonathan-led Federal Government on the use and appropriation of the excess crude money, which ultimately created a very wide abyss of enmity between him and the Federal Government. In his days as the Chairman, Nigeria's Governors Forum, he checked the powers of the Federal Government using the forum, this led to his clampdown on virtually all his political life as the Governor, but he said something, that is what matters.

The activities of these brave men show that every so often, the voice of the dissent could be heard from afar and near among the oppressed minorities.

It is rather unfortunate that there is a dearth of these calibre of men today in the South South. This is even more ostentatious that we now have the likes of Governor Ayo Fayose of Ekiti state taking up the responsibility of the South South Governors. Lambasting and lampooning the Federal Government for their insensitivity towards the plight of the Niger Delta Region, a commendable feat that eluded the cowardly governors of the crises-proned region. A reasonable question to ask would be,"What has happened to South South"?

Governor Nyesom Wike started as a vibrant voice for South South, but it was silent immediately after his visit to Aso Rock a fortnight ago. Governor Dickson of Bayelsa state has become a regular visitor to Aso Rock which has further empowered him to plunder his state into a heap of debts and emboldens him to abandon the people he callously claims to govern even on the verge of the Avenger's angst. Governor Ben Ayade is too engrossed with his academic governance to say a thing. Governor Udom Emmanuel is busy granting interviews to media Houses, promising high heavens where there is none, with his pink lips and a white-coloured horn- rimmed glasses, he forms fine boyish all around the place relegating the functions to which he was elected to the background. His chicaneries is a well-known phenomenon. Governor Okowa is but a mere appendage of the PDP. To him,the business of governance ends with the appending of signatures. Governor Adams Oshiomole is already calling for the head of the South Southerners. What is the problem with this set of Governors?

Comparatively, the West will boast of Governor Ayo Fayose, the North has Governor El Rufai. It is then no wonder why the East and South South are the worst regions in Nigeria.

I therefore call on the South South Governors to come home and listen to the groans of its region. They should forge a bond and work together, they should have a policy directive and objective which centers around the problem of the region, they should face the Federal Government as a body, for only then can they win the war against marginalization, pollution, environmental degradation, malnutrition, abuse, poverty, underdevelopment and so on. Let the words of Ken Saro-Wiwa live, let him know he did not die in vain.

In the case of Hon. Aluzu Ebikebuna Augustine, (member LAWSAN House of Assembly representing Constituency III) v The Speaker House of Assembly, praying the Court to quash the unilateral decision of the House Committee of Ethics and Privileges declaring his seat vacant without recourse to the law and adherence to the doctrine of fair hearing.

The Court today, 13/5/2016 sat to hear the substantive suit. Hon. Aluzu, the plaintiff was represented by a Senior Advocate of LAWSAN, Rt. Hon. Dignity Ekop (SAL), who appeared with Aganin Uchewaji.

In the address to the Court, and as contained in the Originating Summons served the defendants, two issues were put up for determination.

(1) Whether the purported declaration of the seat of the plaintiff vacant based on section 17(d) and section 21(1) of the LAWSAN Constitution, 2012. And it's purported report of the LAWSAN House Committee on Ethics and Privileges as contained in the notice dated 7th March 2016, signed by the Clerk of the LAWSAN House of Assembly has any force of law whatsoever.

(2) Whether the absence of fair hearing by the LAWSAN House Committee of Ethics and Privileges vitiates the probative value of the report of the committee.




The Plaintiff also sought two reliefs:

(1) A declaration that the notice of the purported declaration of the seat of the Plaintiff by the LAWSAN House of Assembly is illegal and unconstitutional and therefore null and void.

(2) A declaration that the Plaintiff remains a member of the you of Assembly.

Nsinyene Charles, J., after listening to the submission of Dignity Ekop (SAL) granted that:

The right to be heard is a fundamental right of every citizen,and since the defendants was not in court or his Lawyers, he extended time to avail the defendant the opportunity to enter his defence and appear in court at the next court sitting.

The ratio was also applied in the case of Nango Nango Douglas v Uwana Akpan, Ubokolo v The Speaker, LAWSAN House of Assembly.

The case was adjourned to the 18th of May 2016 for further hearing.

THE MESSIANIC RISE OF SENATOR BASSEY ALBERT AND THE RE-AWAKENING OF UYO SENATORIAL DISTRICT

When Francis Bacon intoned that “Some are born great, some achieve greatness ,some have greatness thrust upon them’’ he had Bassey  Albert in mind. This assertion was further emphasized by the understanding that when a man is born, it is only in rare cases will he break through the barriers and convention of his age and send signal to the future. Almost almost in such cases, he will suffer persecution, for the world does not like to be jerked out of its comfortable patterns of privileges and power. However, to insist that providence must have ordained this conflation is to take nothing away from the man himself. His spacious, supple intelligence, his personal charm, his firm grasp of substance and symbol and nuance and his capacity for engagement and empathy, his unflappable disposition, his quiet self-confidence, his talent for organizing, plus that silky oratory that never fails to connect  uplift and and inspire.

The name Obong Bassey Albert (OBA) needs no formal introduction in Akwa Ibom State. It has become the best selling brands in the annals of Nigerian political history. The Akwa Ibom born financial expert and immediate past commissioner for finance is known by all and sundry in Akwa Ibom state. His political dexterity and sagacity, his all-encompassing personality, in spite of his calm mien had already guaranteed him a large space in the hearts of Akwa Ibom people. This is evident in his overwhelming victory at the polls. In the euphoria of change, Obong Bassey Albert stepped into a new political arena as a Senator, howbeit with a differing song of ‘Change’. The 8th Senate did not know that Senator OBA’s addition to its fold will change the semantics of its members from the chest-beating ‘History and Pedigree’  to the contemporary axiom of ‘Brains and Vigor’, that, of course, had already been achieved for Nigeria.

Last December, at Christmas, Senator OBA displayed one of his signatures in the middle of a time that was unanimously described by Nigerians as ‘The worst Christmas ever’ OBA defied the yearnings of his personal treasury to supply gas free to the entire people of Uyo Senatorial District which he represents. This was indeed another show of extraordinary love for its people, and there is no doubt that Uyo Senatorial District has, for the first time, felt the impact of having a Senator, for George Bernard Shaw had noted that ‘One man who has a mind and knows it, can always beat ten men who haven’t and don’t’.

In recent times, the online media has become awash with senator OBA’S scholarship scheme for students of Uyo Senatorial District studying in tertiary institution. Due to the high level of chicaneries that is always the character of such magnanimity by politicians, some students developed cold feet. I visited the online blog, what I saw melted my heart. The blog is designed with a tincture of passion for service, I saw dedication and genuine commitment to the challenges confronting the Uyo Senatorial District, I saw an inspired sacrifice built on selfless service, I saw an icon reserved for request for assistance, I saw a sense of brotherhood built on genuine love. It is often said that every war has it turning point, the definitive turning point for the students of Uyo Senatorial District is having OBA in the senate, and like a fine wine, senator OBA will get better with more political responsibilities.

On online media, Senator OBA does not hide his passion for service to his people, you will see him taking out time in his busy schedule to post on his personal account, almost appealing to Uyo Senatorial students to apply for the scheme. He educates them on the proper passport to use and other regular filling of the form, while also assuring the defaulters that they will not be screened out based on that mistake.

With the above observation, it could be concluded that, the Senator representing Uyo Senatorial District has set the pace in empowerment in Akwa Ibom State, and has led the pack of other Senators in grass-root development and programmes. Akwa Ibom will be better off than this, if the other two Senators follow suit.

In the LAWSAN Legislative Council, Faculty of Law, University of Uyo, 5th February, 2016.

The event was the inauguration of the LAWSAN Legislative Council.

As the Constitution stipulates, the election of the Chief Whip of the House, which is the reserve of Constituency II, was conducted, Emediong Ekanem emerged against Martins Ukpe after scoring 15 votes to Martins 10.

The election of the Leader of the House was next, being the exclusive reserve of the Constituency III class, Dominic Akpan (Deity) stood for the electiob, but having not been challenged for the post, emerged the Leader of the LAWSAN Legislative unopposed.

The election of the Deputy Speaker of the House became a point of law as the two clbtenders, Uwana Akpan, a three time member of the House and Nango Douglas exchanged legal jibes.

While Uwana Akpan questions Nango's eligibility to stand for the election, citing Section 16(3) of the LAWSAN Constitution as his basis, Nango Douglas countered him, maintaining that he had escaped the limitations of that section having been a member of the House in 2012 as a Diploma student, Uwana Akpan further argued that, granted he was a member of the House, but he is not using the same Diploma registration number again and hence, he is stepping into the House as a first timer.

Section 16(3) provides thus:

"No member of the House shall be elected into Principal Office except he has previously been a member of the House for one cacademuc session..."

While commenting on it, the LAWSAN President cired section 60 and referred them to the LAWSAN High Court for interpretation.

This, the election of the Deputy Speaker of the House have been kept in hold, pending the decision and the ruling of the court.

The ferocious and intrepid Activist in University of Uyo and Chief Press Secretary to the 2014/2015 LAWSAN Government Uwemedimo Dominic (Paapa Akpan) has issued out a timely warning to those seeking elective offices in LAWSAN and threatens to re-awaken the LAWSAN High Court from its current state of doldrums in a move he described as helping the Federal government fight impunity by instituting action against those who will lie under oath before standing election.

In a statement which the foremost Activists released 13/1/2016 which he titled "LAWSAN, ATTENTION! BEFORE THE ELECTION" admonished political desperados in the Faculty vying to contest an election in LAWSAN to "open a LAWSAN Constitution as a matter of legal duty to check and be sure that he has the Constitutional requirements in terms of CGPA to stand for their respective offices before they purchase forms."

If there is anything this no nonsense activist is known for is that he does not issue out empty threats. It can be recalled that in this 2015/2016 session, he dragged the College of ClassReps to court for what he perceived as usurpation of the powers of the Vice President.

He craved the indulgence of his colleagues (memners of his Constituency) to pay particular attention as they will not be shielded from prosecution if they are found wanting.
